IT participates in risk assessment by providing technical context about what systems exist, what threats the organization faces, and what controls are currently in place. IT responds to and helps investigate breaches. IT maintains audit logs and evidence of control implementation. IT does NOT determine whether data can be used for a certain purpose—that's Privacy Rule and legal. IT does NOT create privacy policies—that's compliance and legal. IT does NOT manage patient consent and authorization—that's Privacy Rule and compliance.
The mistake many healthcare organizations make is assigning HIPAA ownership entirely to IT. This turns IT into the compliance department and sets up IT to be blamed for gaps that actually exist in legal or business processes. From day one, establish clear ownership: who owns the risk assessment, who owns Privacy Rule documentation, who owns breach response coordination, who owns the annual compliance review. Without that clarity, every HIPAA question becomes an IT question, and IT gets held responsible for gaps in areas they don't control.
Building a Compliant Environment From the Ground Up
If you're starting HIPAA compliance from scratch, the path is straightforward but requires discipline: start with a risk assessment, use the risk assessment to inform control selection, implement controls systematically, document what you've built, and maintain the documentation over time.
